The terms that govern your use of kaikai.africa and any booking you make through it.

1. Introduction

Welcome to Kaikai Travel. These Terms & Conditions govern your use of https://kaikai.africa (the "Website") and the booking of any travel packages, tours, or services offered through it.

By accessing or using our Website and services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Definitions

  • "We", "us", "our": Kaikai Travel (Pty) Ltd
  • "You", "your", "customer": the person making a booking or using the Website
  • "Package", "service", "booking": any travel product offered on our Website
  • "Partners", "suppliers": hotels, tour operators, transport providers, and other third parties involved in delivering services
  • "Website": https://kaikai.africa and all its subpages

3. Eligibility

By using our services, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding contract
  • All information you provide is accurate and complete
  • You are not using the services for any unlawful purpose

If you are booking on behalf of others, you accept these Terms on their behalf and confirm that all travellers meet any applicable requirements.

4. Bookings & Contracts

4.1 Booking Process

  1. Select your desired package and complete the checkout process
  2. Review your order summary carefully before confirming payment
  3. Upon successful payment, you will receive a booking confirmation email
  4. A binding contract is formed when we issue the booking confirmation

4.2 Pricing

  • All prices are displayed in Botswana Pula (BWP) unless otherwise stated
  • Prices are subject to change until a booking is confirmed
  • We reserve the right to correct pricing errors. If an error is discovered after confirmation, we will notify you and offer the option to accept the corrected price or cancel with a full refund

4.3 Availability

Bookings are subject to availability. If a package becomes unavailable after payment, we will notify you immediately and offer an alternative or full refund.

5. Payment Terms

5.1 Payment Methods

We accept payments via credit/debit card through Cybersource (our payment gateway, provided via Absa Botswana).

5.3 Late Payment

If the balance is not paid by the due date, we reserve the right to cancel the booking and retain the deposit.

6. User Accounts

6.1 Registration

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials.

6.2 Account Termination

We may suspend or terminate accounts that violate these Terms, including but not limited to:

  • Providing false information
  • Attempting to circumvent payment processes
  • Abusive behaviour toward our staff or partners
  • Using the Website for fraudulent purposes

7. Intellectual Property

All content on the Website, including text, images, logos, designs, software, and trademarks, is owned by or licensed to Kaikai Travel. You may not reproduce, distribute, modify, or use any content without our prior written consent.

8. User Conduct

You agree not to:

  • Use the Website for any unlawful purpose
  • Attempt to gain unauthorised access to our systems
  • Submit false or misleading information
  • Interfere with the proper functioning of the Website
  • Transmit any viruses, malware, or harmful code
  • Engage in any activity that could damage our reputation

9. Third-Party Services

Our packages may include services provided by third-party suppliers (accommodation, transport, tours, etc.). While we carefully select our partners, we are not liable for:

  • The quality of services provided by third parties
  • Acts or omissions of third-party suppliers
  • Changes made by suppliers to their offerings

Any claims related to third-party services should be directed to the relevant supplier. We will assist where reasonably possible.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Kaikai Travel's total liability for any claim arising from a booking is limited to the total amount paid for that booking
  • We are not liable for indirect, incidental, or consequential damages (including loss of enjoyment, inconvenience, or additional expenses)
  • We are not liable for losses caused by force majeure events, including but not limited to: natural disasters, pandemics, war, civil unrest, terrorism, government actions, strikes, or adverse weather conditions
  • We do not exclude liability for death or personal injury caused by our negligence or for fraudulent misrepresentation

11. Travel Documentation & Requirements

You are solely responsible for ensuring that you and all travellers in your booking:

  • Have valid passports (minimum 6 months validity beyond travel dates)
  • Obtain the necessary visas, permits, and vaccinations
  • Meet all health and entry requirements for your destination
  • Have adequate travel insurance

We provide general guidance but accept no liability for failure to meet these requirements.

12. Travel Insurance

We strongly recommend that all travellers obtain comprehensive travel insurance covering:

  • Medical expenses and emergency evacuation
  • Trip cancellation and interruption
  • Lost or delayed baggage
  • Personal liability

13. Complaints

If you experience an issue during your trip:

  1. Immediately notify the relevant supplier (hotel, tour guide, etc.) to give them an opportunity to resolve it
  2. If unresolved, contact us within 14 days of the issue arising
  3. Provide full details and any supporting documentation

We will investigate and respond within 14 business days.

14. Governing Law

These Terms are governed by the laws of the Republic of Botswana. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Botswana.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or a notice on our Website. Continued use of our services after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and Delivery Policy, constitute the entire agreement between you and Kaikai Travel regarding your use of our services.
